1. Your license to use InstaCal
InstaCal is distributed through Apple's App Store. Your purchase is governed by Apple's Licensed Application End User License Agreement, and these terms add to it. Where the two conflict, the App Store agreement controls for the matters it covers.
Subject to these terms, Higher Bar Apps grants you a personal, non-transferable license to install and use InstaCal on Apple devices you own or control, as permitted by the App Store's usage rules. InstaCal is licensed, not sold. You may not copy, modify, reverse-engineer, resell, or redistribute the app except where the law expressly allows it.
2. Calendars and services you connect
InstaCal works with the calendars on your device and, if you choose, connects directly to third-party services such as iCloud, Google Calendar, Microsoft 365 and Outlook.com, Fastmail, Yahoo, CalDAV servers, Todoist, and Zoom. Those connections run between your device and the service you selected. Higher Bar Apps is not an intermediary and does not receive the data.
- You are responsible for those accounts. Connecting a service means you have the right to use it, and your use of it through InstaCal remains subject to that service's own terms and policies — including Zoom's Terms of Service for Zoom meetings InstaCal creates in your Zoom account.
- What InstaCal does on your behalf. When you ask it to, InstaCal creates, updates, and deletes events, reminders, tasks, and meeting links in the connected accounts. Those changes are yours; review them as you would in the provider's own app.
- Disconnecting. Removing an account in InstaCal deletes the credentials the app stored for it. Data already held by the provider, such as a meeting created in Zoom, stays there and is managed through that provider.
- Availability. Third-party services change their APIs, limits, and terms. Higher Bar Apps works to keep integrations running but cannot guarantee that any third-party service will remain available or unchanged.
3. Acceptable use
Use InstaCal only in ways that are lawful and that respect the terms of the services you connect. Do not use it to interfere with, overload, or gain unauthorized access to any service or to anyone else's data, and do not attempt to circumvent App Store licensing or the app's security.
4. No warranty; limitation of liability
InstaCal is provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Higher Bar Apps does not warrant that the app will be error-free, that it will stay compatible with every calendar server or provider change, or that any third-party service will remain available.
To the fullest extent permitted by law, Higher Bar Apps is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, lost events, missed meetings, or lost profits arising from your use of or inability to use InstaCal. Higher Bar Apps' total liability for any claim relating to InstaCal is limited to the amount you paid for the app. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
Keep your own backups. Your calendar data lives with your calendar provider. InstaCal is a client for that data, not a backup of it.
5. Termination
You can stop using InstaCal at any time by deleting the app, which removes its local data from your device as described in the Privacy Policy. Higher Bar Apps may end this license if you materially breach these terms. Sections 4 through 8 survive termination.
6. Changes to these terms
Higher Bar Apps may update these terms when InstaCal's features or legal obligations change. The effective date at the top of this page identifies the current version. Continuing to use InstaCal after a change means you accept the updated terms.
7. Governing law
These terms are governed by the laws of the United States and of the state in which Higher Bar Apps is based, without regard to conflict-of-law rules. Nothing here limits consumer rights that apply to you under the law of your place of residence.
